Learn About Your Massachusetts Lemon Law Rights
Owners of defective cars in Massachusetts can take advantage of a number of consumer based laws in order to obtain assistance. In addition to the Massachusetts lemon law, M.G.L. ch 90 § 7N 1/2, there also exists a federal lemon law known as the Magnuson-Moss Warranty Act which can be used either on its own, or together with the state lemon law to assist consumers. Both of these laws require the manufacturer to pay your attorney fees. We will use these provisions in the law to collect our costs and feed directly from the manufacturer. You will never be billed by us so do not hesitate to contact our Massachusetts lemon law attorney to evaluate the specifics of your situation.
Does My Car Qualify?
What is the lemon law in Massachusetts? The Massachusetts Lemon Law provides very effective means for consumers to obtain help if they have a defective car. Specifically, the Massachusetts lemon law states that it is presumed to be satisfied if either of the following requirements is met:
1. The car was presented for repair on 3 or more occasions for the same nonconformity within one year or 15,000 miles from the date of original delivery of the car and the problem still exists; OR
2. The car has been subject to repairs for any combination of defects which total 15 or more business days (the days do not have to be consecutive) within the same time/mileage period described in 1.
Under this provision the manufacturer must also be allowed a final opportunity to repair any ongoing defects.
An additional requirement of the Massachusetts lemon law is the defect or nonconformity with the car substantially impairs the use, market value, or safety of the car. Our Massachusetts lemon law attorney can advise you whether your car’s defects satisfy this element of the law. Basically the Massachusetts lemon law will not provide relief for trivial defects. However, what does not constitute a substantial impairment for one person may for another so it is important that our Massachusetts lemon law attorney consult with you regarding this issue. If all the requirements of the Massachusetts lemon law are met then the manufacturer must repurchase or replace your car.
What About the Federal Lemon Law?
Even if your repair history does not satisfy the lemon law, our Massachusetts lemon law attorneys can assess if your car’s repair history is sufficient to qualify you for damages under the federal lemon law known as the Magnuson-Moss Warranty Act. This law requires that your vehicle be presented for repeated repairs. This is a very effective law that helps provide consumers with money damages and sometimes repurchase or replacement relief when the Massachusetts lemon law for cars may not apply.
Our Massachusetts Lemon Law attorney will evaluate your situation free of charge and advise you on whether you may qualify for relief under the Massachusetts Lemon Law. If you do not meet the requirements of the Massachusetts Auto Lemon Law, you may still be entitled to relief under a federal lemon law called the Magnuson-Moss Warranty Act. You have lots of options so take a moment to tell us your problem and we’ll tell you how we can help.
The state of Massachusetts lemon law and other laws cited above require the manufacturer to pay your attorney fees. Therefore, any advice or actual representation that our Massachusetts lemon law attorneys provide to our clients will be done at no charge to you.
