Learn About Your Ohio Lemon Law Rights

What is the lemon law in Ohio? In 1987 Ohio legislators passed one of the most comprehensive lemon laws in the nation. The Ley del limón de Ohio requires automakers to repair defects that affect the use, value, or safety of a new car within the first 12 months or 18,000 miles, whichever comes first. If you are having problems with your new car or truck you should immediately take it to an authorized dealer for repair. The state of Ohio lemon law covers cars and light duty trucks that are purchased or leased.

In order to qualify under the Ohio lemon law, the manufacturer or dealer must be given a reasonable opportunity to fix the problem, and if the problem is not corrected, you might be eligible for a refund or replacement. You are covered by the lemon law even if the problem was discovered late in the protection period and the repair attempts extend beyond one year or 18,000 miles. Failure to comply with parts of Ohio’s Lemon Law is a also violation of Ohio’s Consumer Sales Practices Act.

A lemon vehicle is a new car or light duty truck that has a problem or problems, covered by the warranty, and that substantially impairs the use, value or safety of that vehicle. If you have had problems with your passenger car, noncommercial motor vehicle or motorcycle during the first year or 18,000 miles, whichever occurs first, you should take it back to the manufacturer or the dealer and ask them to fix it. If they fail to correct the problem(s) after being given a reasonable opportunity to do so, you might own a lemon.

¿Califica mi auto?

The following test will help you determine if you are entitled to relief under Ohio’s lemon law for new cars. If you can answer “yes” to any of the following four questions, the manufacturer is presumed to have had a reasonable opportunity to repair your car or truck under the Ohio lemon law. In the first year, or 18,000 miles, whichever occurs first:

  • Have three or more attempts been made to repair one problem and then the problem either continues to exist or occurs again?
  • Has the vehicle been in the shop for a cumulative total of 30 days or more during its first year or 18,000 miles, whichever occurs first?
  • Have eight or more attempts been made to fix different problems?
  • Has one unsuccessful attempt been made to fix a problem that could cause death or serious injury

¿Qué pasa con la Ley Federal Lemon?

Even if your repair history does not satisfy the lemon law, our Ohio lemon law attorneys can assess if your car’s repair history is sufficient to qualify you for damages under the federal lemon law known as the Magnuson-Moss Warranty Act. This law requires that your vehicle be presented for repeated repairs. This is a very effective law that helps provide consumers with money damages and sometimes repurchase or replacement relief when the Ohio lemon law for cars may not apply.

Our Ohio Lemon Law attorney will evaluate your situation free of charge and advise you on whether you may qualify for relief under the Ohio Lemon Law. If you do not meet the requirements of the Ohio Auto Lemon Law, you may still be entitled to relief under a federal lemon law called the Magnuson-Moss Warranty Act. You have lots of options so take a moment to tell us your problem and we’ll tell you how we can help.

The state of Ohio lemon law and other laws cited above require the manufacturer to pay your attorney fees. Therefore, any advice or actual representation that our Ohio lemon law attorneys provide to our clients will be done at no charge to you.
